By downloading, accessing, or using TailgateFans™ ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Eligibility

To use TailgateFans™, you must:

Be at least 18 years of age
Be legally able to enter into a binding agreement
Not be prohibited from using the service under applicable laws
Be 21 years or older to redeem alcohol-related rewards

3. Account Registration

You must create an account to use TailgateFans™. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4. Points and Rewards System

Earning Points: Points are earned by submitting verified tailgate photos during valid game windows at approved stadium locations.

Point Values: Point values for different activities are determined at our sole discretion and may change without notice.

Redemption: Points can be redeemed for rewards at participating sponsor locations. Rewards are subject to availability and sponsor terms.

Expiration: Points may expire if not used within the timeframe specified in the App. Expired points cannot be reinstated.

5. Prohibited Conduct

You agree NOT to:

Submit fake, manipulated, or misleading photos
Use GPS spoofing or location manipulation
Create multiple accounts to earn additional points
Share or sell your account or rewards
Upload content that is illegal, harmful, or offensive
Attempt to hack, reverse engineer, or exploit the App
Harass other users or engage in fraudulent activity
Violate any applicable laws or regulations

6. Content Ownership

Your Content: You retain ownership of photos you submit. By uploading content, you grant TailgateFans™ a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for app purposes.

Our Content: The App, including its design, features, and branding, is owned by TailgateFans™ and protected by intellectual property laws.

7. Verification and Fraud Prevention

We use various methods to verify submissions, including GPS location, time-based validation, and AI photo analysis. We reserve the right to reject submissions, revoke points, or suspend accounts if we suspect fraudulent activity. Our decisions on verification and fraud are final.

8. Sponsor Rewards

Rewards are provided by third-party sponsors and are subject to their terms and conditions. TailgateFans™ is not responsible for the quality, availability, or fulfillment of sponsor rewards. Disputes regarding rewards should be directed to the sponsor.

9. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, you lose access to your account, points, and any unredeemed rewards.

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ACCURACY OF POINT CALCULATIONS, OR AVAILABILITY OF REWARDS. USE THE APP AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILGATEFANS™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Changes to Terms

We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify you of significant changes through the App or email.
